1. About My Cozy Cross Stitch
My Cozy Cross Stitch is a marketplace: the patterns sold here are created and owned by independent designers (“Creators”) who list their work on our platform. When you buy a pattern, you buy a license to that Creator’s design, delivered through our website. We operate the platform, process orders, and host your Digital Library.
2. Accounts
You need an account to download purchases, comment on the blog, or sell as a Creator. You’re responsible for keeping your login information safe, and for all activity under your account. Please notify us right away at hello@mycozycrossstitch.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.
3. Digital Products & Delivery
All patterns are digital downloads. No physical product is shipped. After purchase, your files appear in your personal Digital Library, where you can re-download them anytime. Every pattern includes at least a printable PDF chart; extras such as Pattern Keeper files or black & white charts depend on the Creator and are listed on each pattern page.
4. Your License to Use Patterns
Purchasing a pattern grants you a personal, non-transferable, non-commercial license from the Creator to stitch the design for yourself or as gifts. You may not share, resell, sublicense, or redistribute the pattern files in any form, or use them to create derivative patterns. Selling finished items made from a pattern requires the Creator’s prior written permission. Ownership of each design remains with its Creator.
5. Payments, Pricing & Refunds
Prices are shown in US dollars. Payments are processed securely by trusted third-party providers (such as Stripe); we do not store your card details. Because our products are digital and delivered instantly, all sales are final.
If a download is broken, incomplete, or not as described, contact us at hello@mycozycrossstitch.com. We’ll make sure you receive working files or, where we consider it appropriate, a refund.
6. Gift Cards
Gift cards are available in fixed amounts, are delivered digitally, and can be redeemed against purchases on the site. They never expire and carry no fees. They have no cash value, cannot be exchanged for cash, and are non-refundable except where required by law.
7. Membership
Our membership (the Stitch Club) is a recurring subscription: the price and billing frequency are shown clearly before you subscribe, and your plan renews automatically until cancelled. You can cancel anytime from your account, as easily as you signed up; cancellation takes effect at the end of the current billing period, and benefits already delivered (such as patterns added to your Library) remain yours under the license in Section 4.
8. Selling as a Creator
Creators apply through our platform and are approved at our discretion. By listing a pattern, you confirm that you own or control all rights to it, that it doesn’t infringe anyone else’s intellectual property, and that it meets our listing requirements (including a printable PDF chart). You grant My Cozy Cross Stitch a non-exclusive license to host, display, and market your listings on the platform and in our promotional channels.
Sales are subject to the platform commission shown in your creator account; the remainder is paid out to you as described in your creator dashboard. You remain responsible for your own taxes. We may remove listings or suspend creator accounts that breach these Terms, receive credible infringement complaints, or harm the trust of our community. Buyers’ personal data you receive through the platform may only be used to fulfil orders, never for your own marketing.
9. Community Content
You can post comments and reviews. Keep them kind, honest, and on-topic. Don’t post anything unlawful, infringing, hateful, or spammy. By posting, you grant us a license to display your content on the platform; we may moderate or remove content at our discretion.
10. Intellectual Property & Complaints
The My Cozy Cross Stitch name, branding, website content, and platform are our property. Patterns belong to their Creators. If you believe content on our site infringes your copyright, email hello@mycozycrossstitch.com with the work concerned, the listing URL, your contact details, and a statement of good-faith belief. We investigate all credible complaints and remove infringing content.
11. Acceptable Use
You agree not to violate any laws, scrape or copy our content or Creators’ work without permission, circumvent download protections, or attempt to disrupt the security or functionality of the website.
12. Disclaimer of Warranties
The platform and its products are provided “as is” without warranties of any kind, express or implied. Patterns are created by independent Creators; while listings are reviewed before publication, we cannot guarantee that any pattern is error-free, nor that the website will always be uninterrupted.
13. Limitation of Liability
To the fullest extent allowed under U.S. law, My Cozy Cross Stitch will not be liable for indirect, incidental, or consequential damages, nor for disputes between buyers and Creators beyond the remedies described in Section 5. Our total liability for any claim will not exceed the amount you paid for the product concerned.
14. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
15. Changes to These Terms
We may update these Terms occasionally, for example when new features launch. The “Effective Date” always reflects the most recent update. By continuing to use the site, you agree to the updated Terms.
