1. Who we are
My Cozy Cross Stitch (“we”, “us”) is operated by M B Squared Inc., a company based in Phoenix, Arizona, USA. You can reach us at hello@mycozycrossstitch.com.
My Cozy Cross Stitch is a marketplace. The patterns sold here are created and owned by independent designers (“Creators”). We run the platform, review listings, take payment, collect applicable taxes, deliver your files, and host your Digital Library. When you buy a pattern, you receive a license to that Creator’s design (see Section 5).
2. Who can use the site
You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase. Younger stitchers are welcome to use the site with a parent or guardian who agrees to these Terms on their behalf. Creators must be at least 18.
3. Your account
Some features (downloads, comments, the Stitch Club, selling) need an account. Please give accurate information and keep your login details safe: you are responsible for activity under your account. Tell us right away at hello@mycozycrossstitch.com if you suspect someone else is using it.
4. Digital products & delivery
All patterns are digital downloads; nothing physical is shipped. Right after payment, your files appear in your personal Digital Library, where you can download them again at any time while your account is open. Every pattern includes at least a printable PDF chart; extras (such as a Pattern Keeper file, a black & white chart or a size guide) depend on the Creator and are listed on each pattern page.
5. Your license to use patterns
Buying a pattern gives you a personal, non-exclusive, non-transferable license to stitch the design for yourself and to give or display the finished pieces. You may print the chart for your own use.
You may not:
- share, resell, upload, or distribute the pattern files, in whole or in part;
- sell or publish copies, adaptations, or derivative patterns of the design;
- sell finished items made from a pattern without the Creator’s written permission (some Creators allow small-scale sales; their pattern page will say so).
Each design stays the property of its Creator.
6. Prices, taxes & payment
Prices are shown in US dollars and are set by each Creator. Prices are shown before tax. Where the law requires it, sales tax, VAT or GST is calculated from your location and added at checkout, and you will see the full amount before you pay. We collect these taxes and pay them to the relevant tax authorities.
Payments are handled securely by our payment processor, Stripe. We never see or store your full card details. If your bank charges a currency conversion fee, that fee is between you and your bank.
7. Refunds & right of withdrawal
Because patterns are delivered instantly and can’t be “returned”, sales are final, except when a file is faulty, incomplete, or not as described, in which case we will fix it or refund you. The details are in our Refund Policy.
If you live in the EU, the UK or another country with a similar rule: you normally have 14 days to withdraw from an online purchase. For digital content, that right ends once the download is made available to you. By completing your purchase you ask us to give you access to your files immediately, and you acknowledge that you therefore lose your right of withdrawal. This never affects your rights if a file is faulty.
8. Gift cards
Gift cards are sold in fixed amounts, delivered by email, and redeemable against purchases on the site. They do not expire and carry no fees. They have no cash value, can’t be exchanged for cash, and are non-refundable, except where the law says otherwise. Please keep gift card codes safe: we can’t replace a code someone else has used.
9. Stitch Club membership
The Stitch Club is a subscription that renews automatically at the price and frequency shown before you subscribe (plus any applicable tax), until you cancel. You can cancel at any time from your account, as easily as you signed up. Cancellation takes effect at the end of the current billing period, and you keep your benefits until then. Patterns added to your Library through the membership stay yours under the license in Section 5. Unused monthly downloads don’t roll over unless the membership page says so. If we change the price, we’ll tell you in advance and the new price applies from your next renewal; you can cancel before then.
10. Selling as a Creator
Creators apply and are approved at our discretion. Selling on My Cozy Cross Stitch is governed by our Creator Agreement, which forms part of these Terms for Creators.
11. Community content
You can post comments and reviews. Keep them kind, honest, and on-topic: nothing unlawful, infringing, hateful, harassing, or spammy, and no sharing of pattern files. You keep ownership of what you post, but you give us a free, worldwide license to display it on the site and in our promotion of it. We may moderate or remove content at our discretion.
12. Copyright & intellectual property
The My Cozy Cross Stitch name, logo, website design and content (other than Creators’ patterns and users’ posts) belong to us. Patterns belong to their Creators.
We respect intellectual property and expect everyone on the site to do the same. If you believe something on our site infringes your copyright, email hello@mycozycrossstitch.com with the subject “Copyright notice” and include:
- your name, address, phone number and email;
- a description of the work you believe is infringed;
- the link(s) to the content on our site;
- a statement that you have a good-faith belief the use isn’t authorized by the owner, its agent, or the law;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them, and your physical or electronic signature.
We remove content that is the subject of a valid notice and let the person who posted it know. If you believe your content was removed by mistake, you can send us a counter-notice with the same details. We close the accounts of repeat infringers.
13. Acceptable use
Please don’t break the law, share or scrape patterns or other content, get around download protections, create accounts in bulk or with false details, interfere with the site’s security or performance, or use the site to harm or deceive others.
14. Suspension & closing your account
You can close your account at any time by contacting us. We may suspend or close an account, or remove content, if you breach these Terms, if we’re required to by law, or to protect our community. Where reasonable, we’ll tell you why. Sections that by their nature should survive (such as licenses already granted, disclaimers and limits of liability) continue after your account closes.
15. Disclaimer
We work hard to keep the site running smoothly and every listing is reviewed, but the site and patterns are provided “as is” and “as available”. To the extent the law allows, we make no other warranties, express or implied, including about uninterrupted service or error-free patterns. This doesn’t limit your right to a refund for faulty files (Section 7) or any rights you have under consumer law that can’t be excluded.
16. Limitation of liability
To the fullest extent the law allows, M B Squared Inc. is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the site. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that can’t be limited by law, such as for fraud or, where applicable, for death or personal injury caused by negligence.
17. Your responsibility to us
If you breach these Terms or the law, or post content that infringes someone’s rights, you agree to cover the reasonable costs and losses we suffer as a result, including reasonable legal fees, to the extent the law allows.
18. Governing law & disputes
These Terms are governed by the laws of the State of Arizona and of the United States, without regard to conflict-of-law rules. Any dispute will be handled by the state or federal courts located in Maricopa County, Arizona. If you are a consumer living outside the US, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts. Before going to court, please contact us: most problems are solved quickly with a friendly email.
19. Changes to these Terms
We may update these Terms, for example when we launch new features or when the law changes. The effective date at the top always shows the latest version. For important changes, we’ll let you know by email or on the site before they apply. If you keep using the site after that, the updated Terms apply.
20. General
These Terms, together with our Privacy Policy, Refund Policy and, for Creators, the Creator Agreement, are the whole agreement between you and us. If any part is found unenforceable, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of our business.
